Why It Matters

Deeds look like simple one-page documents and they almost never are. A poorly drafted deed can wipe out the homestead exemption, trigger documentary stamp tax, expose the property to a child's creditors, or freeze the title in a way that takes a probate to undo.

Florida offers a powerful planning tool — the enhanced life estate deed, often called a Lady Bird deed — that lets you keep total control of your home during life, sell it whenever you want, and pass it outside probate at death. Done right, it avoids probate without losing the homestead protections you need today.

We handle deed work as a discrete legal service so clients who only need a deed don't have to engage a full estate plan, but we always look at the deed in the context of the rest of your situation before we draft it.

Life Estate Deed

An older alternative to the Lady Bird that gives a remainder interest now. Useful in some Medicaid scenarios but loses many of the controls a Lady Bird preserves.
